Declassification of Information and RTI




The following report there is a brief stand of the government on the declassification of the records.

There is a similar Act in USA which is called Freedom of Information Act. It is being aggressively used by research scholars as well as journalist fraternity there. However, in India, with the advent of Right to Information Act, many loopholes and a peculiar outcry by the executive, are giving different direction to the spirit of the act.

The Freedom of Information Act in America had given rise to many conspiracy theories in the administrative activities of executive in America. In the recent times, it had lead to revealing of the Deep Throat under Watergate Scandal during Nixon Tenure.

In India also, the death of Subash Chandra Bose and that of Lal Bhadur Shastri, and similarly, the reorganisation of states, the 1945 Shimla Conference, 1946 Cabinet Mission plan, the Constitutional Assembly working from 1946 to 1950 and many more are such cases which are being the topics of questions of RTI seekers. Similarly defence deals, the Shimla Summit of 1972 are other issues which are being rejected on the issue of Security of India factor.

On the whole, Declassification of Information on regular basis, well defined policy of declassification and delivery of the information and the RTI Act are important debate issue.

The issue as such can appear in Main 2009 but it is definitely a point to be prepared for Interview in March/April 2010.

Civil Services Act 2009




The news item of rediff news is highly opinionated.

HOWEVER Civil Services Reform, especially the state versus centre relation, the appointments of bureaucracy and tenure are some such issues, which can be topic of question in Mains or at the best in the Viva. The report contains some points to be picked but use caution as it has been tilted. Secondly due not include party names directly while discussing the appointments of key administrative posts at state level. It may put you in a fix if the appointment is directly concerned to your state.

Article 16 (4) and Sub-categorisations of Dalits.



It is a highly sensitive issue. The Centre is trying to give powers to the State government to introduce the sub-categorisations of SC in their state. The Apex court and High courts have already declared as anti-constitution move. It has brought in limelight the fundamental right 16(4) and Presidential powers under the Article 341.
The above issue, though sensitive and controversial, yet it may emerge in question papers. The suggestive articles 16(4) and 341 which is a presidential power may become important both for Prelims and Mains of 2009.

The Social security Bill has been passed. Now it will premit to establish National Security Advisory Board (NSAB).
It is in a way a repeat posting. However, there is need to emphasis that social issues must be taken serious and adequate notes should be prepared on them.

MTP Act 1971 May be Reviewed

Govt. mulls to enhance legal limit for abortion to 24 weeks

The recent judgement of the Mumbai High Court in Nikita Mehta case, has moved the Union Health Minister to review the Medical Termination of Pregnancy Act 1971 in light of recent technical advancements.

It is reported on the link that "According to MTP Act 1971, a pregnancy can be legally aborted only if its continuance is a threat to the woman’s physical or mental health, or if there is a substantial risk of neo-natal baby to develop any physical or mental abnormalities or be seriously handicapped."

Sikkim becomes first state to enforce 'model' police act - www.ddinews.com

The Sikkim Government has passed the Sikkim Police Act 2008. It has come into force from September 5, 2008.

The Act has now brought into force a fixed tenure for police officers, establishment of Police Accountability Commission etc.
